Kentucky Judge Blocks H-2A Worker Protection Rules

A federal judge issued an injunction against the Biden administration’s expanded protections for farmers in the U.S. under the H-2A program. The injunction, issued by a U.S. District Judge in Kentucky, applies in Ohio, West Virginia, Alabama, and Kentucky.

Plaintiffs in the case argued that the Department of Labor rules would allow foreign workers to unionize. The American Farm Bureau and partners were also issued a preliminary injunction by the U.S. District Court in Mississippi, preventing the DOL from enforcing its Workers Protection Rule.

“Farmers appreciate the men and women who choose to work on their farms, and they take seriously the responsibility of ensuring a safe workplace,” says AFBF President Zippy Duvall. “While workers should be treated fairly and respectfully, we also believe the DOL rule was overly broad to the point of being unlawful.”

The AFBF’s lawsuit was the first to stop key aspects of the rule for all farmers.
